Primary school teacher Peter Lekakeny (right) consults with his lawyer, Morgan Omundi, at the Eldoret Law Courts during a case in which he is accused of defrauding victims of KSh 3.5 million over a three-acre parcel of land in Uasin Gishu County, dating back five years.
In a hearing at Eldoret Court, a clinical officer narrated how he was allegedly defrauded of KSh 2.3 million by a primary school teacher who had promised to sell him a two-acre piece of land in Uasin Gishu County.
Kennedy Chepkonga, a clinical officer based at Eldama Ravine sub-county hospital in Baringo County, testified before Senior Resident Magistrate Keyne Odhiambo, explaining that despite signing a sale agreement and completing payment five years ago, the seller, Peter Lekakeny, has yet to honor his part of the deal.
Chepkonga recounted that after making the full payment through a bank transfer, Lekakeny treated him like a stranger on the property. The land in question, identified as Sergoit/Karuna Block 3/Tugen/81, was sold to him for KSh 2.3 million.
“When I hired a tractor to plough the land, Lekakeny’s two brothers chased me away, claiming they were the rightful owners of the disputed land,” Chepkonga told the court. The incident, which occurred in March 2022, left him shocked and threatened as the brothers warned him to keep off the land, which they said was registered in their mother’s name, Nolari Nashuru Semeiyoi.
Chepkonga testified that this confrontation took place after he had visited the property with Lekakeny on July 14, 2019, in Moiben sub-county. He has since filed a lawsuit against the teacher, accusing him of defrauding him of the KSh 2.3 million.
Lekakeny, represented by lawyer Morgan Omundi, has denied the fraud charges.
In a separate testimony, another victim, Elijah Kiptoo, a librarian at Kenya University’s Kitui campus, detailed how he was allegedly defrauded KSh 1,150,000 by the same teacher. Kiptoo said he entered into a sale agreement with Lekakeny on July 7, 2019, for a one-acre piece of land, also part of Sergoit/Karuna Block 3/Tugen/81.
Kiptoo explained that he made an initial payment of KSh 1 million through a bank transfer and cleared the remaining KSh 150,000 two weeks later. However, in October 2021, he was shocked to receive a letter from Lekakeny’s mother, stating that he had trespassed on her property, which was allegedly registered in her name.
Both cases are set to proceed with further hearings on November 11.
