Justice Reuben Nyakundi -Presiding Judge Eldoret High Court/File

“I have never lost sleep over charges of killing my wife and my two
months old child” these were the words of 31 year old Julius Kimutai
before a High court in Eldoret ,while being cross-examined by the
state counsel Mark Mugun over the brutal murder of two.

Kimutai left the packed court presided over by Justice Reuben
Nyakundi in stitches when he casually claimed that he has never been
disturbed by the gruesome manner in which he ended the lives of the
two.

“At no time have I ever been disturbed in my sleep over the grisly
manner in which my wife and two month old child met their death on
the fateful day of July 2, 2017,” Kimuati said.

Kimutai who is a father of four, was being cross-examined in a case
where he is accused of strangling to death his wife, Judith Jemaiyo
and Abel Kipchirchir

The accused, who looked composed in the dock, committed the alleged
criminal offence on July 2, 2017 at Simotwo village in Elgeyo Marakwet
County.

He denied the murder charge when he appeared in court after he was
declared fit to stand trial by Moi Teaching and Referral hospital in
Eldoret where he had been taken for mental assessment.

The accused been detained at the Eldoret GK remand prison after he was
denied bond citing his safety in the community after he was connected
to the gruesome killing of his wife and child.

There was shock in court when the murder suspect disowned his own
signed statement he recorded in national language, Kiswahili at the
Iten police station on the day he was arrested before going into hideout
after he committed the alleged crime.

He told the Judge he never went to school and that he did not know
what he was signing if ever he recorded any statement at the police
station.

“Your honour, I categorically deny that I signed the statement at the
police station
as being claimed by the prosecution. I am not even aware of the
written and signed statement which the prosecutor is showing me in
court, argued the accused person.

This prompted the state counsel to ask the court to issue summons to

the Chief Inspector who investigated the case in order to shed

over the matter.

“Your honour, I would request that we summon the investigating officer,
who is a chief inspector, to come to court and shed more light in
relation to the signing of the statement by the accused person after
he was arrested in connection with his wife and two month old child,”
stated Mugun.

Four prosecution witnesses have so far testified against the accused
person in the murder case facing him.

Justice Nyakundi adjourned the case until May 9,for further direction.
