Court to Deliver Verdict on Rigathi Gachagua Impeachment Case on June 8

A three-judge bench will deliver its judgment on June 8 in the case challenging Rigathi Gachagua’s impeachment, with the outcome expected to determine whether the former Deputy President remains eligible to contest for public office in future elections.

A three-judge bench is set to deliver its judgment on June 8, 2026, in the petitions challenging the impeachment of former Deputy President Rigathi Gachagua.

The date was confirmed after all parties in the case concluded their submissions before the court.

Gachagua’s legal team presented 18 grounds contesting the impeachment process carried out by the National Assembly and the Senate, arguing that the former Deputy President was denied a fair hearing and that the process lacked adequate public participation.

According to the lawyers, the impeachment proceedings failed to meet constitutional standards and violated due process requirements.

However, both the Senate of Kenya and the National Assembly of Kenya defended the process, urging the court to dismiss the petitions.

The two Houses maintained that the impeachment was conducted in line with the Constitution and existing laws, insisting that Gachagua was granted sufficient opportunity to defend himself during the proceedings.

They also argued that the public was adequately involved before the impeachment process was concluded.

“We will retire and prepare a judgment bringing these proceedings to a close. We hope to do that on June 8 in the ceremonial hall at 11:00 am,” Justice Eric Ogolla said.

The anticipated ruling is expected to have major political implications ahead of the next General Election. If the impeachment is upheld, Gachagua could be barred from seeking public office, while a ruling in his favour would clear the path for his political comeback.
