A woman involved in a contentious land dispute with the Ministry of Defence has been accused of forgery in a case that has garnered national attention due to allegations of fraud and unlawful land appropriation.
Miriam Kubai, who possesses power of attorney for the Leseru Tebeson Farmers Society, appeared before the Chief Magistrate’s Court in Eldoret on Tuesday to face serious charges.
Prosecutors claim that Kubai falsified a certificate of confirmation of a grant to misrepresent the ownership of a disputed parcel of land located near Moi Barracks in Uasin Gishu County.
The prosecution asserts that the forged document falsely featured the authority of the High Court in Kakamega, claiming to be a legitimate court-issued certificate.
Investigators allege that the counterfeit certificate was intended to wrongfully transfer ownership of the contested land from the Ministry of Defence to private individuals.
“This is a grave situation involving not just forgery, but also an alleged effort to mislead government entities and unlawfully alter land ownership records,” an unnamed court official stated following the hearing.
Kubai, who pleaded not guilty to the charges, was granted release on a bond of KSh1.25 million while the case proceeds.
The hearing has attracted significant public interest due to the military’s involvement and its wider implications for land ownership and disputes in the area, where contested property claims have been increasing.
The case is set for mention on May 12, 2025, as the defence and prosecution prepare for what appears to be a high-stakes legal confrontation.
Authorities have subsequently issued a strong warning to the public against altering official land records, emphasizing that “any attempt to deceive the state will be met with the full force of the law.”
