A senior cyber-crime detective from the Directorate of Criminal Investigations (DCI) headquarters in Nairobi has presented CCTV footage in the Eldoret High Court, allegedly showing how a lawyer was involved in the brutal murder of his colleague.
Inspector Daniel Kieny, while testifying before Presiding Judge Robert Wananda, stated that the incident occurred during a three-day house party at an apartment in the Annex area along the Eldoret-Nakuru highway.
“The party, which ended in tragedy, had been organized by an Eldoret-based advocate who invited more than ten friends, including the accused, Abel Mogaka, and the deceased, Calvin Ngaira,” said Kieny.
According to the detective, a fierce confrontation broke out between the accused and the deceased, culminating in a fatal attack. “The accused used a broken bottle to stab the deceased on the left side of his neck during a fight outside the apartment,” Kieny testified.
The court, packed with legal professionals and family members, heard that the CCTV footage captured critical moments leading to the incident. “The footage clearly shows the accused person holding something in his right hand while chasing the deceased before stabbing him, even after he had retreated from the fight,” Kieny explained.
Ngaira, who had been practicing law in Eldoret for barely three months, succumbed to his injuries at MediHeal Hospital, where he was rushed in critical condition by his friends.
The detective dismissed claims by the accused that the deceased was the aggressor, insisting that the evidence from the footage contradicted that narrative.
The footage also showed that before the altercation, the accused and the deceased were seen walking out of the apartment engaged in a cordial conversation before returning inside. However, moments later, the accused is seen exiting the house holding a glass, followed closely by the deceased, before the fatal altercation ensued.
Kieny further told the court that he personally retrieved the footage from the scene in the presence of the investigating officer, Sergeant Sophia Hassan, who is based at Langas Police Station. The prosecution stated that the tragic incident occurred between 17:08 and 17:15 hours on May 18, 2019.
Prosecution counsel Brenda Oduor filed an application to recall the first witness, Edith Chebet, to provide further clarity on the events leading to the stabbing. “We intend to recall only one witness and the investigating officer before closing our case,” Oduor informed the court.
Justice Wananda granted the prosecution’s request, assuring the defense that they would have an opportunity to cross-examine the witness. “There will be no prejudice against the accused as claimed by his defense,” the judge ruled.
The court adjourned the hearing to March 9 at 8:00 AM.
