On July 19th, the children of the late prominent farmer and politician Jackson Kiprotich Kibor formally requested that Justice Reuben Nyakundi recuse himself from presiding over succession case E049 of 2022.

This demand was submitted to the Eldoret High Court through a detailed letter citing twelve specific concerns, which the family believes demonstrate significant biases and procedural inconsistencies.

One family member stated, “Our concerns are rooted in what we believe to be significant biases and procedural inconsistencies demonstrated by Judge Nyakundi throughout this case. We feel that justice cannot be served under these circumstances.”

The letter meticulously outlines these concerns and provides detailed reasons for each. Another family member remarked, “We have compiled a thorough list of grievances to ensure that our demand is well-founded and that our voices are heard.”

The letter was not only addressed to the Eldoret High Court but was also copied to several key judicial and legal bodies, including the Chief Justice, the Judicial Service Commission, the Law Society of Kenya, the Kenya National Commission on Human Rights, and the Registrar of the High Court in Eldoret. This underscores the gravity of the family’s concerns and their determination to seek a fair and just resolution to their dispute.

Signed by 14 of Kibor’s family members, the letter is part of a broader legal battle over the succession of Jackson Kiprotich Kibor’s multi-billion estate. One of the signatories commented, “We stand united in our pursuit of justice. This is not just about our inheritance; it’s about upholding the integrity of our legal system , we believe our late father’s will was forged in favor of the youngest wife Euniter.”

The family’s move to seek the recusal of Judge Nyakundi highlights the deep-rooted issues they perceive in the handling of their case and their unwavering commitment to ensuring that these issues are addressed. Euniter Kibor, the youngest and fourth wife of the late Jackson Kibor, is the petitioner in the succession case, while the other widows and their 27 children have disowned the will that designates Euniter as a major beneficiary of the 16 billion estate of the late Kibor.
