Deputy Chief Justice Philomena Mwilu has clarified the legal standing of the impeachment process currently underway against the Deputy President, affirming its constitutional legitimacy.

Speaking to the media, DCJ Mwilu emphasized that the proceedings are part of the established legal framework, conducted strictly in accordance with the constitution. “Everything has its first, and the impeachment process ongoing in respect to our Deputy President is not unique; it’s an application of the constitution,” she stated.

She further explained that the impeachment procedure is not arbitrary, but follows a legal process outlined in the constitution. “It is not something that has been plucked from the air. It has a constitutional process to follow, and therefore to that extent, it is a constitutional process.”

Mwilu acknowledged the involvement of the judiciary in various legal challenges related to the impeachment, citing the multiple cases that have already arisen. “It’s been in the courts; you know the number of 20 whatever applications and cases,” she remarked, referencing the significant legal activity around the issue.

However, she was careful to point out that the judiciary’s role would only become relevant if the matter returns to the courts after the Senate makes its decision. “If it comes to the court after the Senate, whatever it is that happens, we don’t know. We cannot anticipate the outcome of the Senate process,” she said.

The Deputy Chief Justice reassured that the judiciary is fully prepared to handle the case, should it be brought before them, as required by law. “It will be handled in the manner the constitution has authorized, in the manner the law has authorized. We cannot go outside the constitution; we cannot go outside the law.”

Her comments come at a time of heightened political tension, as the country watches closely to see how the impeachment process unfolds. Given its rarity in the country’s political history, the case has garnered substantial public and media interest. The process is expected to set a significant precedent for future cases involving high-ranking government officials
