Court Allows Auction of Tuju’s Dari Business Park to Proceed, Halts Entim Sidai Sale Pending Case Determination

The High Court has permitted the auction of former Cabinet Secretary Raphael Tuju’s Dari Business Park to proceed while temporarily halting the sale of the Entim Sidai property.

The High Court has ruled that the auction of former Cabinet Secretary Raphael Tuju’s Dari Business Park may proceed, while at the same time issuing temporary orders stopping the sale of the Entim Sidai property until the case is fully heard and determined.

In its ruling delivered on Wednesday, the court granted partial relief to Tuju, allowing the contested auction of Dari Business Park to move forward, but maintained protective orders over the Entim Sidai property, effectively halting its disposal for now.

The court further directed Tuju to deposit Ksh.50 million within 30 days as security, terming it a key condition for the interim orders to remain in force.

“The court has considered the application and finds no sufficient grounds to restrain the auction of Dari Business Park at this stage,” the judge noted in the ruling, while emphasizing that the Entim Sidai property will remain protected pending full determination of the dispute.

The judge also warned that failure by Tuju to comply with the security deposit requirement within the stipulated period would automatically lead to the lapse of the stay orders shielding the Entim Sidai property from auction.
