An Eldoret court has sentenced a middle-aged man to 12 years in prison after finding him guilty of gang rape and committing an indecent act with an adult in a case that shocked residents of Turbo Sub County in Uasin Gishu County.
The ruling was delivered by Senior Principal Magistrate Kesse Cheronoh, who said the prosecution had presented enough evidence to prove the case against the accused, Benson Simiyu.
According to court documents, the incident happened on January 15, 2025, in the Lower Colombo area. The court heard that the victim, identified as S.M, was attacked at around 9 pm while heading to a nearby shop to buy food for dinner.
The victim told the court, “I was wearing a dress and grey hooded jumper on the fateful night while heading to the shop to buy some items for dinner.”
She said the attackers hit her on the head with a metal rod before robbing her of her mobile phone and Sh1,600.
“I was later rushed to Moi Teaching and Referral Hospital by good Samaritans, where I was examined and treated,” she testified.
During mitigation, Simiyu pleaded for mercy, saying, “Your honor, I am the firstborn and the sole breadwinner of my family.”
However, Magistrate Cheronoh said the offence was serious.
“The accused committed a heinous act against the complainant. He severely assaulted the complainant, stole from her, and proceeded to rape her,” ruled the magistrate.
