Senate Begins Hearing on Governor Mutai’s Impeachment

Kericho Governor Erick Mutai has entered the Senate for a second time within a year to face an impeachment motion that could cut his term short. The hearing of the case starts on Wednesday, August 27, 2025, and will continue through Friday, August 29, 2025, when Senators will sit as a full House to hear and decide his fate.
There are several counts against Governor Mutai, among them being gross violation of the Constitution, abuse of office, and gross misconduct. On the commencement of hearing, he will be read the charges and asked to plead. Upon which, the Kericho County Assembly will present its opening statement by adducing evidence and questioning witnesses in justification of its action in impeaching him.
Mutai, through his attorneys, will then be able to reply. His attorneys will be able to dispute the allegations and produce their own witnesses to dispute the allegations. The two parties will then undergo cross-examination before the Senate continues to debate and finally vote on the matter.
The Senate Speaker, Amason Kingi, has already outlined the process. The final ruling shall be on Friday when Senators who were elected from counties will vote. A majority will vote either to approve or clear the governor of the allegations.
This is not the first time Mutai has faced the threat of removal. Mutai has twice been impeached by the Kericho County Assembly within a year. In the most recent case, 33 out of 47 MCAs voted to have him removed. They accuse him of having sanctioned Sh85.7 million payments to 46 companies for goods and services allegedly not received and work not undertaken.
Despite the severity of the charges, Mutai denies wrongdoing. He accuses the County Assembly of victimizing him and denying him a hearing. Addressing residents before he proceeded to the Senate, he requested their prayers and backing as he embarked on clearing his name.
The impeachment motion was tabled by Sigowet MCA Kiprotich Rogony. The Senate now has the option of whether to show the governor the door or whether he stays put.
