The Eldoret Chief Magistrate on Friday urged the North Rift residents to embrace Alternative Justice resolution mechanisms in order to reduce a huge backlog of 27,000 cases at the law Courts.
Speaking to the Eldoret Media Hub ,Chief Magistrate Dennis Mikoyan noted that the cases shared between 10 magistrates are likely to take over two years and hence the need for the members of public to embrace Alternative justice system to unlock the cases.
” The Policy from the judiciary is that a matter since the day its filed should be heard and determined within one year but yes there is room that should not exceed two years , we have old cases many are under the family Division , that’s succession cases, Land disputes among other cases that take up the large portion of the 27,000 cases”, said Mikoyan.
The Chief magistrate added that they are developing mechanisms to unlock the piled cases by having them determined outside of the Courts through the Alternative Justice System mechanism that will ensure they are determined on time,
“Before the end of this year we will officially launch the Alternative Justice Model for Uasin Gishu county, Through Experience we have learnt that people sometimes agree better when they are outside the Courts”, said Mikoyan.
In Kenya according to The Law society of Kenya (LSK), many cases have extensively delayed due to appeals either at the High Court, Court of Appeal or The Supreme Court .
