Eldoret Woman fears for her life;Rape suspect released

A middle aged woman in Uasin Gishu County is calling upon Police officers at the Eldoret Central Police Station to arrest a man who robbed and ended up raping her.
The woman claims the suspect who was under police custody has since been set free in unclear circumstances.
The victim reported the matter to the Eldoret Central police station that arrested the perpetrator, however the victim has faulted the investigating officer who she claims has been misleading her about the dates set for the hearing of the matter at the Law Courts
The Middle aged woman further claims she made several attempts to contact the Investigating officer in her case, who kept insisting that her matter had been postponed after the magistrate took a maternity leave .
“I feel that there could have been a conflict of interest between the Investigating officer and perhaps the suspect, my case was thrown out of court since I did not appear in court, it pains me because the investigating officer kept on misleading me whenever the matter was coming up in court,”Said the sobbing lady.
The Victim is now pleading to have the suspect re-arrested and that the investigating officer in charge of her case be investigated and prosecuted as well for collaborating with the suspect to defeat justice.
Kimutai Kirui a human right activist with the Center Against Torture, has demanded that legal action be taken upon police officers involved in the said Rape case for what he has termed outright conflict of interest to defeat the course of Justice.

“By the virtue that the victim did not appear in court a week before 29/11/2022 when this matter was thrown out of court ,Section 87 A of the Penal Code gives the prosecutor the powers to have the suspect re-arrested and arraigned in court,”Said Kimutai.
We have appealed to the Central Police Station OCPD Edward Masibo and the Central Police OCS to ensure that officers who are interfering with administration of justice in this case are investigated and arraigned in court.
To this end We have also written a letter to the OCPD and The office of the director of Public prosecution (ODPP) over the same, demanding that the suspect is rearrested and taken back to court as per section 87 A of the Penal Code .
The Kenya National Bureau of Statistics study from 2014 shows ,14 per cent of Kenyan women have experienced sexual violence, everyday 41 women are raped in Kenya.
