An Eldoret Based Advocate under scrutiny by Police and LSK

The Law Society of Kenya (LSK) North rift Branch has condemned the Conduct of an Eldoret Based advocate Boaz Bulbul who  is  alleged  to  have violated the  basic  rights of a Middle  aged  woman  who was evicted in an inhumane manner  from her  matrimonial home in Elgon View  Estate Eldoret.

 

Boaz  is  said  to have  overseen the  execution of  a  court  order  that led  to  the  eviction of  Abimael Jepkemboi Ngeny , an order  that human right groups  have  faulted with the courts .

 

Abimael who is second wife to Richard Kimalel Chesimet a Renowned Business man in Eldoret and Nandi Hills town in Nandi County, was evicted  from her home  between  10th and  12th of  October  where all  her belongs were transferred to  unknown  destination , leaving Abimael and  her  two children vulnerable,

“They Came  to my house at around  noon on 10th ,Advocate  Bulbul was leading  a group of about  fifty  youth who forced  me out  of  the house ,  stashed part of  my  belongings to a waiting  lorry  and on 12th they came back again locked me inside  a  wardrobe, carried  the remainder  of  my properties  and  to unknown location, “Said a Sobbing Abimael.

 

 

Abimael regrets the humiliation she was subjected to in front of her children by the youth who evicted her led by said advocate,

 

 

“The openly carried my underpants, locked me inside the wardrobe in front of my two children who were left crying an attended, They  stole my money over KSh100,000 that was in the house , Later on the  said  lawyer ferried  me to a Hotel lodging and  sent via my phone some Ksh 3,000, all his  was  done against  my will and in pretext of  an existing  court  order ,”Said Abimael.

 

 

Despite  Abimael  having reported the matter at Langas  police  station she  was initially  denied to  enter a formal report  regarding the incident , with police claiming they  had  visited the  scene after receiving calls  from Abimael’s Neighbors   regarding  the  forceful eviction” Noted  Abimael.

 

 

However  interventions from an Eldoret  based  Human rights  activist  Kimutai Kirui  of The  Centre  against  Torture , Abimael was  able  to formally  report  the incident on 26th of  the  same month vide OB49/26/10/2022.

 

 

 

 

Having  registered  the  complaint formally Police  officers  at the Langas  Police  Station have  now commenced investigations into the conduct of  the advocate  Boaz  BulBul,

 

 

“The  Police  officers were  reluctant to help  Abimael Jepkemoi  who  has for the  last  one  and  half  years  been  harassed  by goons   purported  to be hired by her  son in-laws , Hillary Kipkemboi  Chesimet  and  Geoffrey Kipchirchir   Chesimet  who are  said to be the  managers  of their  ailing  fathers’ vast  wealth and  investments ,However  we  have faulted the  Court  Order  that was issued  ex parte , as  Abimael was  condemned unheard which limited  her  rights  to a fair hearing -No Court  in Kenya can issue  eviction orders ex-parte,”Said Kirui.

 

 

Kimutai has noted the tendency by Eldoret advocates who move to courts and fail to expose material evidence which then defeats the cause of Justice. Unjust Process can never give Justice.

 

 

A complaint against the conduct of the Advocate has been launched with the Law society of Kenya LSK North rift branch ,whose chair Henry Kenei  has distanced himself with  and the LSK,

“We strongly condemn such acts , The  LSK is  a professional body  that ensures    its  members carry out  their  duties professionally, The  Human Right  body Filed a  complaint with the body  on behalf  of  the victim and we will investigate  to the latter ” Said Kenei.

 

 

However advocate Boaz Bul Bul  has confirmed  that  Abimael Jepkemoi has  not   been recognized as  a manager of the  Estate and  that the court order issued  by Justice Olga Sewe has not  been challenged,

 

 

“I haven’t received  any complaint  against  me,  either from the Human Rights , The Police  Nor  the Law  society of  Kenya over the matter, but its  true  on humanitarian ground i sent Abimael Ksh 3,000 to pay for  her  accommodation after the  eviction and i also did  some  shopping for her  children,”Said  Bul Bul
