Drama ensued at a disputed prime 3 acres parcel of land whose value is
estimated at sh 30 million at Chepkanga area between a property
developer and a panga wielding middle-aged man along the busy
Eldoret-Iten highway in Uasin Gishu County.
The controversial parcel of land is being claimed by the former
Eldoret East MP Joseph Lagat and a prominent North Rift property
developer Duncan Kitur.
Drama began when Kitur reportedly visited the land in dispute after it
emerged that Lagat who also served as chairman of Lake Victoria North
water Service Board had already ploughed it in preparation to plant
some crops on the disputed property.
Lagat had ploughed the land in spite of an order issued by the Lands
and the Environment Court in Eldoret stopping him from carrying out any
agricultural activities on the property until the matter pending in
court is heard and determined.
In a ruling delivered on March, 14 2018 by the then Justice Millicent
Odeny, she ordered that the status quo remain until the matter before
the court is heard and determined conclusively.
“I certify the matter as urgent and order the status quo be
maintained,” stated Justice Odeny in her ruling.

As Kitur alighted from his car and went straight to the farm to survey
a section of that land that had been ploughed, he was confronted by a
panga wielding man who claimed to be an employee of the former
lawmaker.
The alleged former MP’s employee then ordered the property developer
to keep off the property or face his wrath in defiance, terming him as
a stranger on the disputed land.
“Who has given you the permission to come here, you are a stranger on
this parcel of land and I order you to leave or face the consequence,”
roared the employee.
The employee, who declined to be named, had accused the property
developer of trespassing on his boss’ land while branding the weapon he
was carrying in his right hand at him.
However, Kitur was forced to flee from the scene and drove away at
high speed after the situation threatened to turn violent as a section
of local residents watched the unfolding drama in disbelief.
Kitur later went to the nearby Chepkanga police station where he
recorded a statement with police over threats on his life by an
employee of Lagat.
The property developer who was accompanied by a group of five people
claimed that he had been forced to abandon his property following
threats on his life the former MP whom he claimed has vowed to harm
him over the ownership of the prime land.
He said that he has been reduced to a beggar after Lagat evicted him
from the parcel of land before erecting a perimeter wall around the
property which he argues he has owned for the past two decades.
“I have the title deed of the land whereas the former MP who also
claims ownership of the same has nothing to show that it belongs to
him,” said Kitur.
A senior police officer at the station confirmed to Hubzmedia
that the complainant, Duncan Kitur had recorded a statement with them
over threats on his life.
The officer, who declined to be named, revealed that they have already
launched investigations into the incident but declined to divulge more
details about it.
