A form 2 student who killed daughter unfit to stand trial

A Form two student who killed her 2 year old baby girl is unfit to stand trial, Eldoret High Court heard today.
This was brought to the attention of Justice Reuben Nyakundi by State counsel Asiyo Juliet when the high school student from Nandi County appeared before him for mention of her case.
The student, ( named with-held ) and who was in full school uniform is said to have strangled to death her baby girl, an action that led to her arrest by police attached to the directorate of criminal
investigations department.
She is accused of committing the alleged offense on 11th June 2020 at Kaptel village in Nandi county.
When the matter came for mention, the State counsel informed the court that the mental status of the student is not stable and requires further observation and treatment.
“Your honor, the student is not fit to stand trial for murder case going by the findings of the mental assessment report from a psychiatric which is in our possession,’ said Juliet.
Justice Nyakundi said that he could not release the student on bond until her guardians or parents avail themselves in court with a view to find out from them whether it would be safe for her to continue
with medication while at home.
“I was ready and willing to release this learner on bond so that she can go home, but since none of her parents or guardian has come to court, I order that she be taken back to Eldoret GK prison,” directed
Nyakundi.
He made the ruling after the student informed the court that she could not see her father or mother in court, adding that she was not in a position to know whether her parents were aware the matter was coming up for mention today.
“I have looked around the courtroom and I cannot see my parents. I do not know why they failed to turn up your honor,” said the student.
The Judge directed that the case be mentioned on 23rd November to find if the student will be in a position to take a plea.
