IPOA opposes petition to halt murder trial of police officers in Ojwang case

The Independent Policing Oversight Authority has opposed a legal petition by two senior police officers seeking to stop their prosecution in connection with the death of blogger Albert Ojwang, calling the move a calculated attempt to evade justice, Monday, June 30.

Officer Commanding Station Samson Taalam and Constable James Mukhwana, who are charged with murder in Kibera High Court Criminal Case No. HCCR E010 of 2025, filed an application to halt the trial. IPOA contends the petition is an obstruction of justice.

“The petitioner is simply trying to bypass the justice system. This court should not allow public officers to use legal loopholes to avoid facing the law,” IPOA said in its court filing.

IPOA stated that its prosecution follows an independent investigation that found sufficient grounds to charge the officers. The authority warned that granting the officers’ plea would set a dangerous precedent, potentially shielding public officials from accountability in cases involving torture or extrajudicial killings.

The agency is urging the court to dismiss the application and allow the murder trial to proceed.
