A 33-year old man will spend 40 years in prison after he was found guilty by an Eldoret court of incest which he is said to have committed two years ago under the influence of alcohol and drug abuse.

 

The accused, Edwin Mule, who the court described as unfit to leave with any children leave alone his own children shocked the court when he pleaded with the Presiding senior resident magistrate Barnabas Kiptoo to give him a lenient sentence.

 

In his mitigation which took less than two minutes, the accused asked the Magistrate to give him a shorter jail term that will enable him to fend for his family when he comes out of prison.

 

“Your honor, I plead that you give a shorter jail term so that I come out of prison while still strong enough to fend for my young family,” pleaded Mule to the astonishment of the packed court.

 

Mule had been charged with incest contrary to section 20 (1) of Sexual offence Act in an incident he committed on diverse dates between 13th March 2020 at Huruma estate in the outskirt of Eldoret town, Uasin Gishu County.

The minor who is a 13 year old moved the court in an emotional testimony as she narrated
how her father used to defile her almost on a daily basis after coming home in the wee hours of the night while drunk.

 

“My dad took advantage of my vulnerability by stripping me naked and then sexually abused me at night under the influence of alcohol in our mud walled house,” recounted the minor during her emotional testimony in-chief.

 

While passing out the sentence, the Magistrate regretted that the accused took advantage of his daughter’s vulnerability to molest her sexually under the watch of the accused person’s mother whom he described as evil.

 

“It baffles me that the police officers based at Baharini police station along the Eldoret-Webuye highway led by the Officer Commanding Station (OCS) let the victim’s grandmother free,” argued Kiptoo.

 

He has ordered the OCS to arrest the grandmother who has been adversely mentioned in the matter for investigations and ensure the file is available to the Director of Public Prosecution within 45 days from the date of the judgment.
