An Eldoret court issues warrant of arrest against woman, for defrauding job seekers!

An Eldoret court  Tuesday cancelled a bond granted to a businesswoman
accused of defrauding three job seekers of sh 280,000 under the
pretext of securing them visa cards to the Gulf State.

The trial court was forced to cancel Susan Kiere’s bond after it was
informed that she had sneaked out of the court and disappeared just
when the hearing of the case was about to start.

In a twist of event Kiere later called to inform the court that she
was not feeling well, the reason why she left in a huff to go and seek
urgent medical attention in the hospital.

Kiere was charged that she fraudulently obtained sh 280,000 from
Nicholas Njoroge on diverse dates between 30th November 2022 and 1st
January 2023 at Nickline Golf consultancy company in Eldoret, Uasin
Gishu County.

The suspect allegedly duped the complainant into believing that she
was in a position to help him to process visa cards for Leah  Njeri,
Faith Kemei and Brenda Kosgei to travel to the United Arab Emirate for
business opportunities.

She had been released on a sh 100,000 bond after pleading not guilty
to the fraud charge.

Senior Resident Magistrate Rosemary Onkoba noted that compelling
reasons had been raised by the prosecutor, Sidi Kirenge, warranting
the termination of the bond.

Kirenge had brought to the attention of the court about the accused
disrespect for the court by disappearing just when hearing of the case
was about to start.

“The accused has been in court since morning pending the hearing of
her case and then she decides to sneak out , only to
call back saying that she was feeling unwell. Your honor, the accused
had not informed the court that she was sick all along the period
she was here,” argued Kirenge.

According to Kirenge, the accused has been using the same trick to
evade justice for her action in connection with a fraud related case
she is facing in the court.

“Your honor, I have gone through some of the medical reports from the
hospital she claims to have gone to seek treatment she presented in
court and we discovered that they were all fake after closely
scrutinizing the documents,” said Kirenge.

Kirenge further brought to the attention of the court that this was
the third time the hearing of her case has been halted on ground that
she was feeling unwell without producing a genuine medical report to
support her claims.
She consequently asked the court to cancel her sh 100,000 bond and
also issue a warrant of arrest against her.

The State Counsel told the court that the accused was to be blamed for
the slow pace at which hearing of the case was taking, noting that
this will be the third adjournment since the case commenced.

“The accused was in court and did not indicate whether she was unwell.
If indeed she was unwell, she could have indicated to the court when
it made the direction for the matter to proceed,” said Onkoba.

While terminating her bond, the Magistrate stated that it was  clear
that the accused person wants to frustrate the witnesses and
consequently ordered that the warrant of arrest be issued against her.

“The accused has not shown any goodwill at all, hence the bond term is
cancelled with immediate effect,” ruled Onkoba.

The case will come up for mention on October 19 for confirmation on
whether the warrant of arrest has been effected.
