Eldoret:60-year-old Asian trader sues son in law for assault!
A 60-year-old trader of Asian origin has sued his son -in-law together with his two brothers and their father for assaulting him before eloping with his daughter in-law.
Documents in court indicate that the accused subjected the complainant to bodily harm.
On Wednesday Ibrahim Sadik narrated to Eldoret Principal Magistrate Mogire Onkoba how his in-laws subjected him to thorough beatings in his homestead at Elgon -View estate.
“I became unconscious due to thorough beating when my in-laws descended on me with kicks and blows from every direction. Despite my old age they battered me mercilessly,” Mr Sadik told the court as he recalled the incident.
Mr Sadik promised to present in court video footage from CCTV cameras showing how the accused family feasted on him with blows, fists and kicks from every corner.
Mr Sadik was testifying in a case where his son-in-law Khalid Umar, his two brothers Asif Salim and Tawqir Munir and their father Umar Mohammed are jointly charged with assaulting him in Elgon View estate in Eldoret town on April 23,2022.
The four members of one family are facing charges of assaulting and causing actual bodily harm contrary to section 251 of the penal code.
They were also charged with an alternative charge of malicious damage to property belonging to the complainant.
The complainant regretted that it was a taboo for a son in-law to be in direct body conduct with his father and mother in-law as his son in-law did.
He also alleged that the incident has subjected him to ‘immense mental harassment’.
Due to the incident his son has already initiated the legal process of divorce after his in-laws forcefully ejected their daughter from her marriage as well as assaulting his father.
The accused denied the charges terming the allegation by their former father in law as a diversionary to the ongoing divorce process.
They were released on Sh10,000 cash bail each.
The son in-law in question is expected to testify in the case on June 6 when hearing will continue.
